Welcome to AVISA! These Terms of Service (“Terms”) govern your access to and use of the AVISA mobile application, website, and related services (collectively, the “Platform”). By creating an account, accessing, or using the Platform, you agree to be bound by these Terms. If you do not agree, do not use AVISA.

1. About AVISA

AVISA is an educational and social aid platform that connects donors, organizations, and beneficiaries (such as orphanages, schools, and underprivileged communities) to raise funds for education, healthcare, and other approved social aid needs. We are a registered legal business  in Cameroon, operating under applicable laws and regulations, with the potential for international expansion.

2. Eligibility

You must:

• Be at least 18 years old to create a fundraising campaign or make a donation.
• Be legally capable of entering into a binding agreement.
• Provide accurate, truthful, and up-to-date information during registration.

If you are creating an account on behalf of an organization, you must have the legal authority to bind that organization to these Terms.

3. Our Role

• AVISA is a platform that facilitates fundraising. We do not directly control how funds are used by campaign organizers.
• We verify partner organizations (e.g., orphanages) before onboarding, but we are not responsible for the conduct of users or organizations outside the Platform.
• AVISA does not provide banking, investment, or insurance services.

4. Creating and Managing Campaigns

• Campaign creators must provide truthful, transparent, and verifiable information about their cause.
• Misrepresentation, misuse of funds, or fraudulent campaigns will result in immediate suspension and possible legal action.
• AVISA reserves the right to reject, suspend, or remove campaigns at any time for any reason, including suspicion of fraud, violation of laws, or actions that may harm AVISA’s reputation.

5. Donations

• Donations are voluntary and non-refundable unless required by law or under AVISA’s Refund Policy.
• AVISA processes payments through secure third-party payment providers.
• Donors acknowledge that AVISA does not guarantee the success or completion of any campaign.

6. Fees

• AVISA charges a 10% platform fee on all donations made to fundraising campaigns.
• AVISA charges a 5% platform fee on all donations made to orphanage profiles.
• Payment processing providers may apply additional transaction fees, which are separate from AVISA’s platform fees.

7. Prohibited Activities

You may not use AVISA for:

• Fraudulent, misleading, or illegal purposes.
• Funding activities that promote hate, violence, or discrimination.
• Money laundering, terrorist financing, or other financial crimes.
• Campaigns unrelated to AVISA’s mission (education, healthcare, and social aid).

8. Content and Intellectual Property

• You retain ownership of content you post (images, text, videos) but grant AVISA a non-exclusive, royalty-free, worldwide license to use it for promotional, operational, and security purposes.
• You must have the rights to all content you upload.

9. Account Suspension and Termination

AVISA may suspend or terminate accounts for:

• Violations of these Terms.
• Fraudulent or suspicious activity.
• Requests from law enforcement or regulatory bodies.

10. Disclaimers and Limitation of Liability

• The AVISA Platform is provided “as is” without warranties of any kind.
• AVISA is not responsible for any losses arising from campaigns, donations, or third-party services.
• In no event shall AVISA’s total liability exceed the amount of fees paid by you to AVISA in the six (6) months preceding the claim.

11. Dispute Resolution

• Disputes should first be resolved amicably through mediation.
• If unresolved, disputes will be subject to the exclusive jurisdiction of the courts of Cameroon.

12. Changes to the Terms

AVISA may update these Terms at any time. Continued use of the Platform after changes means you accept the revised Terms.
